1. Acceptance of Terms

By accessing or using the Blue Harbor platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Blue Harbor ("we," "our," or "us"). We may modify these Terms at any time by posting revised Terms on this page. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Description of Service

Blue Harbor is a web-based platform designed for watercraft owners and boating enthusiasts. The Service provides tools for vessel management, maintenance tracking, document storage, expense management, task organization, photo galleries, real-time weather data, NOAA tide predictions, and AI-powered boating intelligence. The Service integrates with third-party providers including OpenWeather for weather data, NOAA for tide information, and Stripe for payment processing.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

4. Subscription Plans and Billing

Blue Harbor offers the following subscription tiers:

Basic (Free): Includes core vessel management features for a single boat, basic weather data, maintenance logging, and document storage up to 500 MB.

Premium ($9.99/month): Includes all Basic features plus management of up to 3 vessels, AI-powered boating intelligence briefings, advanced tide charts, priority weather alerts, document storage up to 5 GB, and expense tracking with reporting.

Pro ($19.99/month): Includes all Premium features plus unlimited vessel management, enhanced AI intelligence with extended forecast windows, unlimited document storage, advanced analytics and reporting, API access, and priority customer support.

All paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge the applicable fee to your designated payment method on a recurring basis. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no prorated refunds are provided for partial months.

We reserve the right to change subscription pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle following the notice period.

5. Prohibited Uses

You agree not to use the Service to: violate any applicable law or regulation; infringe upon the intellectual property rights of others; upload or transmit malicious code, viruses, or harmful data; attempt to gain unauthorized access to other users' accounts or our systems; use automated scripts or bots to access the Service without our written permission; redistribute, resell, or sublicense the Service or any data obtained through it; harass, abuse, or harm other users; or use the boating intelligence or weather data as the sole basis for maritime safety decisions.

We reserve the right to investigate and take appropriate legal action against anyone who violates these prohibitions, including terminating their account and reporting violations to law enforcement authorities.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Blue Harbor and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to the Service, including vessel photos, documents, and maintenance records.

By uploading content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or your account.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Weather and Tide Data: Weather forecasts, tide predictions, and boating intelligence provided through the Service are for informational purposes only and should not be relied upon as the sole source for maritime safety decisions. Always consult official NOAA and Coast Guard resources and exercise sound judgment before going on the water.

AI-Generated Content: The AI-powered boating intelligence feature uses artificial intelligence to generate recommendations. These are automated suggestions and may not account for all local conditions, hazards, or circumstances. Use your own judgment and experience when making boating decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUE HARBOR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may request a copy of your data within 30 days of termination by contacting support@blueharbor.app. After 30 days, your data may be permanently deleted from our systems.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction and venue of such courts.
